Data Act

The EU Data Act applies from September 12, 2025 and introduces rights for customers using cloud-based services in the European Union.

This regulation aims to rebalance the relationship between providers and customers, giving customers more freedom, transparency, and security in managing their data. In particular, the Data Act aims to facilitate the transition from one cloud service provider to another by requiring that data be retrievable in a structured and accessible format. It also strengthens safeguards against unlawful international transfers of non-personal data outside the EU and protects customers from unfair contractual terms.

Switching Process

OUTSCALE’s Switching Process aligns with the EU Data Act guidelines and enables data retrieval through standard, secure and transparent mechanisms. Data integrity, protection and clarity are central to this approach, supporting the switching process in line with the EU Data Act.

Data protection from unlawful access

OUTSCALE is committed to protecting customer data from unlawful international governmental access or transfer. Our robust framework includes:

  • Technical measures with state-of-the-art encryption and strict access controls to ensure confidentiality,
  • Organizational measures with a dedicated process to monitor and manage such international access or transfer in accordance with applicable laws and regulations, and
  • Contractual measures with OUTSCALE’s affiliates and suppliers to ensure the enforcement of this process.

OUTSCALE maintains the highest standards of transparency with its customers, to the fullest extent permitted by law, and will take all necessary measures to prevent unauthorized access.

OUTSCALE’s certifications guarantee compliance with strict requirements in terms of data portability and interoperability, protection against illegal data transfers, and contractual balance. 

OUTSCALE provides documentation, secure data export mechanisms, and clear communication to ensure a secure and transparent switching process, in line with the EU Data Act requirements. Customers will find detailed instructions in OUTSCALE’s public documentation under the heading “Reversibility,” which explains how to retrieve their data.  OUTSCALE’s Terms and Conditions reflect these obligations to ensure full compliance with the requirements of the Data Act.
